i personally find dub-con a questionable term at best. if you can't tell whether there's consent or not, there is no consent.

I've always seen dubcon as something where if they weren't on drugs or something they'd normally say no but bc they are on drugs they don't rly say anything ?

yeah, exactly. in discourses about sexual violence and consent though if someone is under the influence that much, they are unable to give consent because they are not in their right mind, for lack of a better term.
